1. Service Description

BounceShift provides email validation services including:

  • Real-time single email validation via API
  • Batch email list validation via CSV upload
  • ESP webhook integrations for bounce and complaint tracking
  • Dashboard access for managing validations and team members

2. Account Terms

2.1 Account Creation

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • You must be at least 18 years old to use this service
  • One person or legal entity may not maintain more than one free account

2.2 Team Accounts

  • The account owner is responsible for all activity under their team account
  • You may invite team members who will be bound by these terms
  • You are responsible for ensuring team members comply with these terms

3. Acceptable Use

3.1 You May

  • Use the service to validate email addresses you have legitimate access to
  • Integrate our API into your applications
  • Connect your ESP webhooks to track reputation data

3.2 You May Not

  • Use the service for any illegal purpose
  • Validate email addresses obtained through illegal means
  • Attempt to reverse-engineer, decompile, or hack our systems
  • Resell or redistribute our service without authorization
  • Use the service to facilitate spam or unsolicited bulk email
  • Exceed rate limits or attempt to circumvent usage restrictions
  • Share API keys or account credentials with unauthorized parties

4. Credits and Payments

4.1 Credit System

  • Our service operates on a credit-based system
  • 1 credit = 1 email validation
  • Credits are non-refundable once purchased
  • Credits never expire
  • Cached validations (within 24 hours) do not consume additional credits

4.2 Pricing

  • Current pricing is available on our website
  • We reserve the right to change pricing with 30 days notice
  • Price changes do not affect credits already purchased

4.3 Free Credits

  • New accounts receive 100 free credits
  • Free credits are subject to fair use policies
  • We reserve the right to limit free credit abuse

5. API Usage

5.1 Rate Limits

  • API requests are subject to rate limits
  • Current limits are documented in our API documentation
  • Exceeding limits may result in temporary throttling

5.2 API Keys

  • API keys are confidential and should be kept secure
  • You are responsible for all activity using your API keys
  • Compromised keys should be regenerated immediately

6. Data and Privacy

6.1 Email Data

  • We process email addresses solely to provide validation results
  • We do not sell email addresses to third parties
  • Validation results are cached for 24 hours to improve performance

6.2 Data Retention

  • Validation history is retained for your reference
  • You may request deletion of your data at any time
  • Account deletion removes all associated data within 30 days

7. Service Availability

7.1 Uptime

  • We target 99.9% uptime for our API
  • Scheduled maintenance will be announced in advance when possible
  • We are not liable for downtime caused by factors outside our control

7.2 Support

  • Support is available via email
  • Response times vary based on issue severity and plan

8. Intellectual Property

  • BounceShift and its logo are trademarks of BounceShift
  • You retain ownership of data you submit to the service
  • We retain ownership of validation algorithms, systems, and processes

9. Limitation of Liability

9.1 Service Provided "As Is"

  • The service is provided without warranties of any kind
  • We do not guarantee 100% accuracy of validation results
  • Email deliverability depends on many factors beyond our control

9.2 Liability Cap

  • Our liability is limited to the amount you paid in the 12 months prior
  • We are not liable for indirect, incidental, or consequential damages
  • We are not responsible for actions you take based on validation results

10. Indemnification

You agree to indemnify and hold BounceShift harmless from any claims, damages, or expenses arising from:

  • Your use of the service
  • Your violation of these terms
  • Your violation of any third-party rights

11. Termination

11.1 By You

  • You may cancel your account at any time
  • Unused credits are not refunded upon cancellation

11.2 By Us

  • We may suspend or terminate accounts that violate these terms
  • We may terminate the service with 30 days notice
  • Upon termination, your right to use the service ends immediately

12. Changes to Terms

  • We may update these terms from time to time
  • Material changes will be communicated via email or dashboard notice
  • Continued use after changes constitutes acceptance

13. Governing Law

These terms are governed by applicable law. Any disputes shall be resolved through appropriate legal channels.
